Terms of Service

1. Parties

Local Site Growth ("we", "us", "our") is a sole trader business based in Christchurch, New Zealand. These terms apply when you request a free first page demo or engage us for a web design project ("you", "client"). Requesting a demo or engaging us constitutes agreement to these terms.

2. Free first page demos

We design the first page of your website at no cost and with no obligation to proceed. A demo is typically ready within a few business days of receiving sufficient project detail; this is an estimate, not a guaranteed deadline.

3. Ownership of demo work

Demo work remains our property until a project is engaged and paid for. If you do not proceed, it will not be published or delivered to you. We may reuse general design concepts and techniques from unaccepted demo work in future projects or our portfolio; we will not reuse your business name, logo, or content.

4. Client-supplied content

You warrant that any text, images, or other material you supply is yours to use or that you hold the necessary rights. You are responsible for any claim arising from material you provide.

5. Ownership on completion

Ownership of the completed website transfers to you on receipt of final payment. Until then, the website and its files remain our property.

6. Timeframes

A full build typically takes two to three weeks from demo approval, once your content is provided. This is an estimate based on typical projects; delays in content or feedback from you will extend it.

7. Payment

Pricing and payment terms for a full project are agreed in writing before work begins, including whether GST applies. Nothing is invoiced that has not been agreed in advance.

8. Revisions

Feedback rounds are included at the demo and build stages. Material changes to scope after work has started may affect timeline or cost and will be agreed with you before proceeding.

9. Post-launch arrangements

Hosting, maintenance, and support arrangements after launch are agreed individually and confirmed in writing. No default arrangement is assumed.

10. Cancellation

You may withdraw at any time before final payment at no cost. If a project is cancelled after paid work has started, a proportional arrangement based on work completed will be agreed in writing before work stops.

11. Confidentiality

Non-public information disclosed by either party during a project will be kept confidential and used only for the purposes of that project.

12. No guaranteed results

We build websites to a professional standard and test across common devices and browsers. We do not guarantee specific outcomes such as enquiry volume or search rankings, as these depend on factors outside a website's design.

13. Liability

We are not liable for losses arising from third-party services outside our control or from client-supplied content under clause 4. To the extent permitted by law, our total liability for any claim is limited to the amount paid for the relevant project, and excludes indirect or consequential loss. Nothing in these terms excludes any right under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 that cannot lawfully be excluded.

14. Force majeure

Neither party is liable for delay or failure to perform caused by circumstances reasonably beyond its control.

15. Disputes and governing law

Disputes will first be addressed through good-faith negotiation. These terms are governed by New Zealand law, and the New Zealand courts have exclusive jurisdiction.

16. General

We may update these terms; changes apply from the date posted. The terms in effect when a project is engaged apply to that project. If any provision is unenforceable, the remainder continues in effect. These terms, together with any written project agreement, constitute the entire agreement between the parties.
